I have a 100% clean driving history.

I was just cruising on the interstate and not really going fast. As I past a cop car, he came out and followed me. He only turned on his siren after about 3 mins. Little confusing. :(

I am quite sure I wasn't speeding at that time.

When he stopped me, 1st thing he asked is if my radar detects laser. I replied I don't know.

He then asked for me licence and reg and went away. When he came back, he told me that since I am still on temporay registration, I had to have it displayed on my rear window. He then said my dealer probably put it in front because my was a vert.

He then said that he shot me twice with a laser and clocked my speed around 85 & 86, on a 70 zone. He said is going to write me a ticket for 10 over @80mph.

When I said I was not speeding, he said I know, your car is a shelby and its fast like a rocket. If you were speeding, I would probably have caught you at over 130mph. He then handed me the ticket and asked me to drive safe.

The next day, I was driving on interstate again and this time, my radar kicked in the Laser alert as I passed by another cop car.

I am now thinking the cop pulled me over because I did not have my permanent plates and the temp (paper) registration was pasted on the front windshield and he could not see it. And that he did not really shoot me with a laser.

On the ticket where he states my vehicle speed and zone speed, there is the check box "SMD". Also, there is the notes on the right side of that outside the form, there is the writing L129c, 2/3, 85, 1039 ft. Like to find out what that means.

Since this is my 1st ticket ever, I am not sure if contesting it would result in getting it worse. Advise from you folks would really be appreciated. Also, the fact that:

  1. police did not stop me immediately after pulling out of the center divide and followed me for few mins. If he already clocked me, he would turn on sirens the moment he pulled out.
  2. police made comments like my car fast like a rocket and responded that if I was speeding, he probably would have caught me over 130mph. Is the police suppose to make statements like this? I felt like I was being discriminated upon because I drive a fast car-shelby gt500.
  3. the fact that he referred to my temp plate being taped to the front window instead of the back, could it be that he was only pulling me over for that and later decide to write me a traffic speeding ticket?

Apart from advice on whether to contest this ticket, I also like to find out what getting a 10 over ticket affects insurance or not.

Please PM is if the topic is sensitive.

Thanks so much!

I don't know the laws in WA.I would call the courthouse and ask what the violation is and call any insurance and ask if it would effect my rates. In Mi. your rates would go up.I just went to court with a lawyer and the cop was nice enough to drop the ticket. It was 4 points and my insurance would have gone way up.They want the money and in a lot of cases will drop or lower the ticket as long as you didn't get smart with the cop.Since you have never had a ticket before more than likely they will drop the ticket. If you don't fight it every cop that pulls you over after this is going to say "so you speed a lot in this car".Fight it.I did.Read this

The ticket is posted at $113. Sounds like going for lawyer is going to run me in the region of $400-$600? For someone with a clean record, will contesting it in court as individual be an option that is viable?

Also, do laywers choose the "mitigation" option (which already implies you commtted offence), or the "contest" option.

Can someone tell me what this means? Can this be bogus too since I don't think he shot me with laser as my radar detector did not go off. My detector is Escort Solo S2. Or could the police aim so accurately that the radar in the dash windscreen did not pick it up?

Thanks

I cant speak from the legal side but can sure speak from the insurance point 10 over will get you an increase in premium PLUS your carrier will flag your
policy prior to renewal every year AND IF YOU ARE IN A PREFERRED driver program you will be downgraded to standard rates

In the states that I lived in, you can take a one day driver's education class that drops the ticket such that it does not appear on your driving record. You might check to see if your state has this option. You can only do this once every several years.

In GA 14MPH or less over does not even go to the State DMV. Insurance never finds out about it. If Any of you have ever driven Around/Through Atlanta Knows 14MPH might get you a ticket, for Inpeading traffic Flow!!

OK, I have to jump inhere on this as your getting some poor information. 1st, in Wa. State you are required to have alicense in the rear and front. Your right that he could not have seen yours so stopping you was within his rights and as your lic. was in the front, is an improper display. Most officers would make the stop to make sure it wasnt a stolen car at least, most wouldnt write you up unless you were an ass. Next those numbers you mention are in referance to the Laser radar he used on you. Has to do with messured distances. And unless your radar unit is able to pick up LASER as well as Radar, it would not have gone off. Also the Laser will not send out a signal until the "trigger" is pulled. at that moment it has also gotten your speed, but does not nessecarily contimue to emit a laser signal that the detector could read and alert you to. He puleld out and followed you w/o turning on his over head lights? No big deal as there is no requirement as to when they have to be turned on. As a rule there are a few things being looked at as your being followed. First is that particular area of road a safe place for him to stop you? Second, its worth following a bit to check see how your driving is. You could be a potential DUI as wellas a speeder and the add. observations on your driving might make or break the case. (sorry about that one, but drunks dont need to be on the road, VW or Shelby right?)I can promise you that 99.9 percent of the police out here do not write tickets for no reason nor do they give your name and info to all the rest so they can all look at you and write you a ticket! And the pay check is the same no matter how many or few tickets are written.Anyone telling you its a "bougus ticket is just full of it and probably has had their fair share! If this is your 1st ticket, before you pay it, call the court listed on the ticket and ask if they have a program where you can pay a fine (normally a 100.00) and defer the ticket for a year. If you dont get any more tickets, yours will go away. The big hit isnt the fine its your insurance, trust me. Hope this helps, feel free to ask for more. 34 years as a cop. drive a 2010 Shelby, 2 Motor cycles and a 2009 Pontiac G8 GXP. Ya I like the power, but I do it when its a good place and time and yes, I got a speeding ticket about 6 years ago and had it coming! Steve #201 SJCSO

I've deserved every ticket I got and been let out of a few I should have recieved. I worry with the Shelby that there is a speed where you just go straight to jail and you would be begging for the ticket and the insurance premium increase instead.

Yours is red? Or as we call it "Arrest me Red" Just kidding. No there is no speed that as the only offense youd go to jail. Speeding tickets in Washington State at least are no longer criminal but civil. NO jail, you just dont get your drivers license renewed.

Since henryv gave you some very good info, I'm not going to repeat it, but will give you another possibility on the numbers. L129c, 2/3, 85, 1039 ft. could possibly be notes the officer would use in a VASCAR speed case or even a simple stop watch. Neither of these would have activated your RADAR detector since neither emits a signal. There prob are not many VASCAR units left but still a possibility. The guys in aircraft tend to use stop watches even though it may be a fancy computerized version.

The best thing to do is research your state's point system, find out if your court has a prosecutor and talk to him/her about plea bargaining to get a speed that wouldn't affect your lic/ins. These guys are mostly interested in clearing their calendar; whether you plead out or are convicted at trial it's still a cleared case for him. He may say no, but it never hurts to ask.

Good Luck!

Just to let you know if you go over the river into Oregon.

Any speed over 100 mph is a straight jail shot and your car is impounded.( it's a criminal matter not a driving infraction)

Stupid law

It seems you would make more people think about running figuring what do they have to lose

Just thought you might like to know

Ron (SnakeDoc) is indeed correct...
What I would recommend is to plead innocent on the ticket and send it in, you'll then get scheduled for a court hearing. If you have the time to go, it's worth it. And, if you plead innocent and request hearing, the officer has to show up in court. MOST of the time, they do show up, but if something comes up, or they get stuck at a "call" and don't show, your ticket is thrown out.
As soon as you arrive to court, sign in, and let them know you need to speak to the District Attorney. He will know why you want to see him, trust me... Don't argue your innocence with him, that's what a judge is for.
You can discuss "options" with him, for either less points and slightly higher fine, or maybe NO points and a bit bigger fine. You want the POINTS to go away, cause that's what your State DMV and Insurance company will count against both your license and your insurance premium. Once you agree on the "punishment" you sign a paper, plead guilty to lesser charge to the judge, and go on your way.

In Massachusetts every ticket makes it to the Merit Surcharge Board. 1 mile over the limit and you get two points added to your license which means another $500 a year for next two years

If you don't get out of the ticket, I would take defensive driving
(1 course allowed a year) and turn in the certificate at the end to your insurance company for 10% off your ins. rate for the next 3 years (if you don't get a ticket you can take defensive driving still for most ins. companies and still get the 10% discount)

Hi guys,

Lots of good advice here on tickets, its to bad he got it in 2007. In WA 10 over is a 2 pointer and things are based off a 3 year record. 2 Pointers are not good and raise insurance premiums. CDL (commercial drivers, trucks) can't waiver or negotiate tickets. 2 two pointers in 3 years will end with suspension of driver liecense for CDL drivers and used to require driving school in the older days.

When I was younger things were more forgiving. Times have changed, for the better?
